English–Bulgarian conveyancing glossary
The words you will meet when buying or selling a home in England and Wales, each with the Bulgarian term people use for it and a plain explanation.
- Conveyancing прехвърляне на имот
- The legal work of transferring ownership of a property from the seller to the buyer.
- Solicitor адвокат (solicitor)
- A lawyer qualified in England and Wales and regulated by the Solicitors Regulation Authority. In Bulgarian it is usually called адвокат.
- Freehold пълна собственост (freehold)
- Ownership of the building and the land it stands on, with no end date.
- Leasehold дългосрочно право на ползване (leasehold)
- Ownership of a home for a fixed number of years under a lease, while someone else owns the freehold. Most flats are leasehold.
- Share of freehold дял от freehold
- The flat owners together own the freehold of their building, usually through a company, and each also holds a lease of their flat.
- Lease extension удължаване на leasehold
- Adding years to a lease, by agreement with the landlord or under the statutory right. A short lease is harder to sell and to mortgage.
- Ground rent ground rent (наем за земята)
- A yearly sum a leaseholder pays the freeholder under the lease.
- Service charge такса за поддръжка
- The leaseholders’ share of the cost of running, insuring and repairing the building.
- Chief rent (rentcharge) chief rent (rentcharge)
- A small fixed yearly payment attached to some freehold houses, common around Manchester.
- Offer accepted приета оферта
- The seller has agreed your price. Nothing is binding yet: either side can still withdraw until exchange.
- Searches проверки (searches)
- Enquiries made to the council, the water company and others about the property and the area around it.
- Local authority search проверка в общината
- The council’s answers on planning, roads, building control and other matters that affect the property.
- Enquiries въпроси към продавача (enquiries)
- Written questions the buyer’s solicitor raises with the seller’s solicitor about the property and its title.
- Title register имотен регистър (title register)
- HM Land Registry’s record of who owns a property and the rights and charges affecting it.
- HM Land Registry Имотният регистър на Англия и Уелс
- The government body that registers ownership of land and property in England and Wales.
- Mortgage offer ипотечна оферта
- The lender’s formal offer to lend, with its conditions. It has an expiry date.
- Deposit депозит
- The part of the price you pay from your own money. It is paid on exchange.
- Gifted deposit дарен депозит
- Money given to you towards the deposit that you do not have to repay. It must be declared to your lender.
- Source of funds произход на средствата
- Evidence of where the money for your purchase came from, which solicitors and lenders must check.
- Exchange of contracts размяна на договорите (exchange)
- The moment the purchase becomes legally binding and the completion date is fixed. The deposit is paid then.
- Completion приключване на сделката (completion)
- The day the money is paid, ownership passes and you get the keys.
- Chain верига от сделки
- Linked sales and purchases that depend on each other. A delay anywhere in the chain delays everyone in it.
- TR1 TR1 (акт за прехвърляне)
- The Land Registry deed that transfers ownership from the seller to the buyer.
- Transfer of equity прехвърляне на дял
- Adding or removing someone as an owner of a property, often after a marriage or a separation.
- Remortgage рефинансиране на ипотека
- Moving your mortgage to a new lender or a new deal, without moving home.
- Stamp Duty Land Tax данък при покупка на имот (SDLT)
- The tax paid to HMRC on buying property in England. The amount depends on the price and on your circumstances.
- Land Transaction Tax данък при покупка на имот в Уелс (LTT)
- The Welsh equivalent of Stamp Duty, paid to the Welsh Revenue Authority.
- Client care letter писмо с условията (client care letter)
- The letter that sets out the terms on which the solicitor acts for you. The retainer starts when you sign and return it.
- Completion statement сметка за приключване
- The statement of every sum due at completion, and the balance you need to send.
- Indemnity insurance застраховка (indemnity insurance)
- A one-off policy that covers a known defect in the title or paperwork, such as a missing certificate.
- EWS1 form формуляр EWS1
- A form some lenders ask for on flats in taller buildings, confirming the safety of the external walls.
- Power of attorney пълномощно
- A document that lets someone sign on your behalf. For a property in England it must meet English formalities.
- Apostille апостил
- A certificate that makes a document issued in one country valid for use in another.
